CANCELLATION POLICY

– Cancellation of membership contract for any reasons, excluding the Consumer’s Right to Cancel and Additional Rights to Cancel pursuant to New York State Law, will be permitted following a cancellation fee of $79 or remaining contract dues, whichever is less. All cancellations are processed through VENT Fitness Member Services department with 30 days written notice via ventmemberservices.com.

The following documentation is needed for cancellation due to physical disability (excluding pregnancy), and a written Cancellation request  via ventmemberservices.com must be submitted within 30 days of the Cancellation activation request: Doctors note (must include Doctor’s address and phone number) stating date and nature of injury/disability, lab reports, etc. The date of disability for reasons of releasing liability for payment will be the day on which the documentation is received by the VENT Fitness Member Services Department via ventmemberservices.com. VENT Fitness may require that another physician, agreeable to you and VENT Fitness, and at VENT Fitness’s expense, examine you.

VENT Fitness reserves the right to relocate its facilities.  If at any time due to a facility relocation or permanent change of residence by a member. Member’s place of residence becomes more than 25 miles from any facility operated by VENT Fitness, member may at its discretion choose to terminate their membership.  Payment on this agreement will be suspended upon legitimate verification that the members address is more than 25 miles from any facility operated by VENT Fitness.  This documentation must be delivered to the club or attached to the Cancellation Request Form submitted on ventmemberservices.com. Valid proof of relocation would be: Drivers License showing new address, Utility Bill in your name at the new address, Mortgage Closing agreement, Copy of Military Orders, Copy of lease agreement, Letter from employer with a copy of pay stub.  Failure to provide the aforementioned proof will hold you liable for the full balance due on your agreement.

Cancellation of Month-to-Month Membership for any reasons, excluding Consumer’s Right to Cancel and Additional Rights to Cancel pursuant to New York State Law, will be permitted following a written request to cancel 30 days prior to next billing date. This request must be submitted via ventmemberservices.com.

All cancellations are processed through VENT Fitness Member Services department with 30 days’ written notice. Please contact Member Services at ventmemberservices.com and submit the “Cancellation Request” form provided.

FREEZE POLICY

Any Member within an existing membership contract requesting a freeze of membership due to medical injury/disability, pregnancy, or temporary relocation (minimum of 60 days to a maximum of one year) must submit documentation along with a written request via ventmemberservices.com. A $10 service fee, a $5 per month freeze fee, as well as the normally scheduled Annual Fee will be drafted by ABC Financial Services.

*Exemptions to the $5 Monthly Freeze Fee would include medical, military, or temporary relocation (including student relocation), and the COVID-19 pandemic. Documentation must be provided to the club in person or via ventmembservices.com in order to waive those fees.

If, at any time, due to a temporary change of residence becomes more than 25 miles from any facility operated by VENT Fitness, a member may, at his discretion choose to FREEZE his membership payment. Payment on this agreement will be suspended upon legitimate verification that member’s address is more than 25 miles away from any facility operated by VENT Fitness. This documentation must be delivered to the club or attached to the Cancellation/Freeze Request Form submitted at ventmemberservices.com. Valid proof of relocation would be: Drivers License showing new address, valid/current Student ID, Utility Bill in member’s name with new address, Mortgage Closing agreement, Copy of Military Orders, Copy of Lease Agreement, letter from Employer with copy of Pay Stub reflecting new address and member’s name. Failure to provide the aforementioned proof will hold member liable for full balance due on Membership Agreement.

 

The following documentation is needed for a membership Freeze due to physical disability (including pregnancy); a written Freeze request via ventmemberservices.com submitted within 30 days of the Freeze activation request; a Doctor’s Note (which must show Doctor’s address and phone number) stating the date and nature of the injury/disability, lab reports, etc. The date of disability for reasons of releasing liability for payment will be the date on which the documentation is received by the VENT Fitness Member Services Department via ventmemberservices.com.

If membership freeze is approved, member is not entitled to use any club facilities during membership freeze. Any use of the clubs’ facilities during a freeze period will automatically void freeze and reactivate membership and dues billing.

There is absolutely no retroactive refund of dues or retroactive time credits. Monthly freeze fee of $5 per month, as well as member’s Annual Fee will continue while the membership is on freeze; the original expiration date of membership will extend by the amount of time the membership is on freeze. Normal membership dues will resume following the freeze period, or if member opts to utilize any VENT Fitness facility during membership freeze.

Approval of a Membership and/or Personal Training freeze is within the sole discretion of VENT Fitness.

 
Any Member requesting a freeze of membership (maximum of six months, with an additional six months at VENT Fitness discretion) must submit a written request via ventmemberservices.com with 30 days’ notice (except when a documented medical condition exists or upon management discretion).
 
A freeze may only be applied to a membership in good standing; all past dues and fees must be collected and active status restored before a membership freeze can take place.
 
Monthly freeze fee of $5 per month, as well as member’s Annual Fee will continue while the membership is on freeze. If membership freeze is approved, member is not entitled to use any club facilities during membership freeze. Any use of the clubs’ facilities during a freeze period will automatically void freeze and reactivate membership and dues billing.
